General
The following booking conditions, together with the general information contained on our website form the basis of your agreement with Viva Spain Rentals. Please read them carefully. All bookings are subject to these terms and conditions. Viva Spain Rentals arranges bookings of properties and services as an agent of the property owner and / or service provider concerned. When you book a property with Viva Spain Rentals you enter directly into a contract with the owner of the property and / or service provider(s) concerned. Viva Spain Rentals is responsible for the administration of your booking, but, except where otherwise stated, does so solely on behalf of, and as an agent of, the property owner / service provider.
In the following booking conditions ‘you’ and ‘yours’ means the lead name of the person who carried out the booking and all other members of the holiday party.
Your Booking
All offers and bookings are subject to availability. The party leader must be over 18 years old at the time of booking. The party leader is responsible for ensuring all payments due are paid to Viva Spain Rentals.
Subject to availability and receipt of all payments due the party leader will be sent via email a booking confirmation showing your booking details and the balance of any monies remaining due. Your binding contract comes into existence when your confirmation is issued. When a booking is within 14 days of arrival a binding contract comes into existence when verbal confirmation of your booking is given and appropriate payments are received.
Please check the details of your confirmation. If anything is incorrect you must inform Viva Spain Rentals immediately. Receipt of deposit monies does not constitute acceptance of a booking. If you book by post or telephone we will sent your confirmation by post unless you advise us otherwise.
Paying for your Booking
When you book your property you must pay the relevant amount due. You will then be sent a written confirmation showing your booking details, monies paid and balance due. If you are paying by cheque, your confirmation will be issued once the cheque has been cleared. If any payment due in relation to your booking is not received by the appropriate date, Viva Spain Rentals, on behalf of the owner, is entitled to cancel your booking. You may be required to make a security payment in cash, in euros on arrival at your accommodation. If applicable the amount will be shown on your confirmation.
Cancellation and changes to your Booking
If you wish to change your booking once a confirmation has been issued, we will endeavour to assist, subject to availability. Where changes can be made an administration charge of 25 euros will be charged, together with any increase in price of the accommodation. However it is important to realise that changes to a booking may result in the cancellation of one booking and the making of another. In which case the cancellation charges set out below will apply.
Circumstances beyond the control of the owner / Viva Spain Rentals (force majeure):
Except where otherwise stated in these conditions the owner and Viva Spain Rentals shall not be liable, jointly or individually, for any changes, cancellation, effect on your holiday, loss or damage suffered by you or for any failure by the owner and or Viva Spain Rentals to perform any of their respective obligations to you which is due to any event(s) or circumstances beyond the reasonable control of either the owner or Viva Spain Rentals ( referred to as ‘Force Majeure’ in these conditions ) By way of example, force majeure includes fire, flood, exceptional weather conditions, terrorist attack, epidemics, destruction or damage of the property by any cause other than negligence by the owner or Viva Spain Rentals, and all similar situations. In appropriate cases for example when your booking has to be cancelled before departure due to ‘force majeure’ Viva Spain Rentals, on behalf of the owner, will however refund all monies paid by you to Viva Spain Rentals for your booking. No compensation, expenses, costs or other sums of any description will be payable by either the owner or Viva Spain Rentals.

Refunds
To qualify for a refund your reason for cancellation must be one of the following, must apply to a member of the party, and with the exception of pregnancy, must have occurred after you made your booking and must prevent you from taking your holiday / rental. Please note you will not receive a refund for pregnancy where the party member is expected to give birth within 14 weeks of the arrival date home.
- Illness pregnancy. Subject to medical evidence of unfitness to travel.
- Death of any party member
- Redundancy; provided employment has been on a continuous basis with the same employer for a minimum of 2 years.
- Jury or witness service in a court of law.
- Illness of death of a close relative
- Your home is declared uninhabitable due to fire, storm, flood, subsidence or malicious damage.
- Unexpected posting with HM forces or cancellation of leave with HM police.
- Unable to reach your destination as a result of snow, floods or as a result of being involved in an accident en route.
You will be asked to complete a Booking Cancellation Form which may require signing by a medical practitioner, employer or a third party.
Your Accommodation
You can arrive at your accommodation at 3pm and depart at 12.30pm unless otherwise stated in your confirmation. Some property owners may require you to pay a security deposit on arrival in cash in euros. If this applies to your booking you will be advised on your confirmation. The security deposit will be refunded at the end of your rental less, if applicable, any cost for breakages and damages.
If your arrival is delayed after 8pm you must contact the person whose details are given on the confirmation so that arrangements can be made for key collection. If you fail to do so, you may not be able to gain access of the property. If you fail to arrive by 12 noon on the day after the start date of your rental, and you do not contact us, your booking will be treated as having been cancelled by you. No refund of any monies paid will be made in this situation.
You and all members of the party agree to keep the property clean and tidy and to leave the property in the same condition you found it. You are responsible to the owner for the actual costs of any breakage or damage in or to the property, along with any additional costs that may result, which are caused by any member of the party, and the owner can require payment form you to cover such costs.
The property owner is entitled to refuse to hand over to you, or to repossess the property if the owner reasonably believes that any damage is likely to be caused , has been caused, or is being caused by any party member. These circumstances will be treated as a cancellation by you. You must not allow more people that the property details states to occupy the property neither can you change the composition of the party during your rental, nor can you take your pet into the property, unless this has been arranged in advance and is shown on the confirmation. If you do any of these things the owner can refuse to hand over the property to you or repossess it. This will be treated as a cancellation by you. In these circumstances no refund of any monies paid by you will be made. Neither the owner or Viva Spain Rentals will have any liability to you as a result of this situation arising. The owner and Viva Spain Rentals will not be obliged to find alternative accommodation for you.
Pets
If you take a pet with you it must be arranged in advance and stated on the confirmation. In most cases an extra cleaning charge of 5 euros per week is payable. If applicable this will be stated on your confirmation. Pets are not allowed on beds or furniture, or in any communal facilities such as swimming pools or shops. Pets should not be left unattended in the property and dogs should be kept on a lead. Registered guide dogs belonging to those with visual and hearing impairments are allowed in all properties
Liability
The property owner and Viva Spain Rentals shall have no liability for any death, personal injury, or theft and damage of your belongings, during the rental period. You must take all necessary steps to safeguard your personal property. Viva Spain Rentals considers adequate Travel Insurance to be essential and advise to include cover for any damage which may occur to the property, personal injury and cancellation cover.
Additional Terms and Conditions relating to Long Term Rentals
In addition to the terms and conditions above that apply to all rentals the following states the basic rights and responsibilities that will be included in your long term agreement.
As the tenant you will be responsible for paying rent on time, repairing any damage(s) caused by you, or those living with you, paying household bills as stated on your agreement, keeping the property secure, keeping the property clean and tidy and returning the property in the same state you found it.
The landlords will be responsible for ensuring the property is clean, tidy and safe when the tenant(s) moves in, ensure the property is secure and everything is in good working order.
At the end of your rental period you may if you wish to do so, apply to extend your length of agreement, you must do so 2 months in advance of the rental period end date.
Essential Information
Health & Vaccinations
No vaccinations are currently required for British or EU citizens visiting Spain. Visitors from other countries should check with their nearest consulate.

The information given is as a guide only.
Car Documentation
If you are travelling to Spain with your car we advise you to contact your insurers for appropriate cover.
Facilities available
Wherever possible we have indicated facilities available. As a guide swimming pools are open during the main summer season: May – September. Whilst every attempt is made to provide the correct opening times of swimming pools, the availability of the swimming pool at your property (unless private) cannot be guaranteed and may be closed due to maintenance work being carried out during certain periods of the year. Unforeseen problems, bad weather and maintenance can prevent facilities being available. We ask you to appreciate that the operation of these facilities is beyond our immediate control and therefore no compensation will be paid for facilities not available.
Low Season Holidays
The benefits of taking a holiday outside of the main season are that resorts are often quieter and roads and beaches less crowded. Sometimes, fewer facilities will be available and this is reflected in the price of your accommodation.
Accommodation Descriptions
All descriptions are carefully checked before appearing on the website and every effort is made to give an accurate description of the property. Where accommodation is stated as having a sea view this means a view of the sea, in some cases this view may be partially obstructed and does not imply that the property faces the sea.
Accommodation problems
In the unlikely event that you experience a problem with your accommodation, you must inform the owner or Viva Spain Rentals immediately in order to be given the opportunity to resolve the matter to your satisfaction.
Lift access
Most apartments have lift access. If availability of lifts are important to you, please state at the time of booking.
Local charges
Water, gas and electricity are included in holiday rentals. For long term rentals they will be payable to the property owner on production of the relevant utility bills and will be stated in the long term rental agreement. Gas is usually supplied by bottles and when empty you must advise the owner / Viva Spain Rentals so that replacement bottles can be provided.
Linen and towels
Bed linen and towels will be provided for the number of beds indicated on the property details. Beach towels are not provided.
Cots, High Chairs, Buggies and Car seats
A full range of baby and toddler equipment may be hired in advance, if you require these you must indicate at the time of booking and the hire cost will be confirmed to you. All equipment meets EU safety regulations.
Wheelchair access
If we consider a property to be accessible by wheelchairs it will be stated on the property information on the website. If this is important to you please indicate at the time of booking. Wheelchairs, mobility scooters and walking aids may be hired locally in advance, subject to availability. Wheelchair adapted transport and minibus for airport transfers are also available, subject to availability. Please request at the time of booking and we will advise the cost.
Airport transfers
If you require airport collection and transfer to your accommodation this may be booked in advance, subject to availability. Please indicate at time of booking and we will advise the cost.
Golf Club Hire
Golf Clubs and buggies are available to hire, subject to availability, please indicate at the time of booking and we will advise the cost. Please note some golf courses will only hire golf clubs on production of a valid handicap card.
Accuracy of property information
Whereas every effort has been made to describe the property as accurately as possible, Viva Spain Rentals shall not be liable to any alteration or removal of facility or equipment by the property owner that has not been notified to us.
